  Alabama has passed HB 287 as the first law that will enact a landlord-tenant law. This will leave Arkansas as the only state without a landlord-tenant law. The bill, which is sponsored by Rep. Jeff McLaughlin, D-Guntersville and Sen. Lowell Barron, D-Fyffe,  grants a "much-needed clarification for landlords as well as tenants."
The bill provides a more streamlined eviction process  by which landlords could evict a tenant within 21 days if he doesn't pay his rent and clarifies the state law on abandoned property and residential tenant deposits.  It also makes it easier to evict tenants who damage property, and creates a uniform standard statewide rather than having varying rules. It also requires that landlords meet "habitability standards" including providing a heating system, electrical hookups and water and sewer capability. Landlords should pay special attention to the clause that specifies that landlord contracts with tenants cannot invalidate state landlord-tenant law.
